Partner Joseph DiGregorio won a significant victory for a client of Barry McTiernan & Moore LLC. He prepared and argued a motion for summary judgment in a case where the plaintiff alleged significant injuries as a result of a fall on our client’s property. In the case, the plaintiff had appeared for a pre-suit 50h hearing and also served a bill of particulars. Using the property deeds and an expert land surveyor, Joe was able to present evidence that the accident location was not on our client’s property. Despite opposition filed by plaintiff’s counsel, the Court after oral argument granted our motion for summary judgment. We were able to establish our entitlement to summary judgment, and plaintiff was not able to raise a triable issue of fact, as the accident occurred on a neighbor’s premises and not our client’s property. The dismissal occurred early in the case and the firm was able to save the client defense costs and protracted litigation. Congratulations to Joe for a hard fought victory.
