James Burbage began his legal career in 1989, after graduating from Fordham University Law School, as a Staff Counsel attorney with Pellini & Poblete, the New York Staff Counsel office for Reliance Insurance Company. While there he defended a variety of cases involving municipal defendants, property owners, construction companies, and auto owners. He was also the primary subrogation counsel for that office. He began developing his interest in coverage questions and trying cases to verdict in Westchester, New York, and Kings Counties and further honed those trial skills by attending a National Institute of Trial Attorneys seminar, in Minneapolis.
In 1996, he became the first Attorney of Record for Reliance Insurance Company in New Jersey. While managing that office he continued developing his trial skills, trying cases to verdict in Passaic, Hudson, and Middlesex Counties and successfully arguing matters in the Federal District Court of New Jersey. That office represented: municipal defendants, trucking companies, product manufacturers, home builders, property owners, and others. He also continued his involvement with New York actions and argued the case of Jefferson Insurance v Travelers Insurance, on behalf of Reliance Insurance, before the New York State Court of Appeals in 1998.
When Reliance Insurance ceased operations, he joined Barry McTiernan & Moore as a Senior Trial Counsel in 2001. He continued to represent the interests of municipal entities, transportation entities, Owners and General Contractors, and sub-contractors within the Labor Law context in a broad variety of claims across the tort spectrum. He has also continued, as needed, coverage analysis. He became a partner in 2011.
He has tried cases for the MTA Bus Company, the New York City Transit Authority, Structure Tone, Pavarini and other construction entities, as well as car owners and property owners, to verdict in Manhattan, the Bronx, Kings and Queen Counties. He has selected juries in these counties as well as Nassau, Richmond, and Westchester and the Southern District.
His practice today is primarily labor law and municipal transportation matters.
He currently belongs to the Yonkers and the Mt. Vernon Bar Associations, where he has provided a CLE class on the Labor Law and is a past member of the New York State Bar Association Torts Committee.
